42 RESOIDTION NO. 1981-5R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ORDERING AN ELECTION TO BE HELD ON THE 4TH DAY OF APRIL, 1981 FOR THE PURPOSE OF ELECTING OFFICIALS FOR SAID CITY AND ESTABLISHING PROCEDURES FOR SAID ELECTION. WHEREAS, the laws of the State of Texas provide that on April 4, 1981, there shall be elected the following officials for this City: Council Member, Place 3 Council Member, Place 4; and WHEREAS, the laws of the State of Texas further provide that the Election Code of the State of Texas is applicable to said election, and in order to comply with said Code, an order should be passed establishing the procedure to be followed in said election, and designating the voting places and presiding officials for said election; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN !1ARCOS, TEXAS: PART 1. That all independent candidates at the election to be held on the first Saturday in April, April 4, 1981, for the above mentioned offices file their application to become candidates for Council Member Place 3 and Council Member Place 4 with the Mayor of this City at City Hall, on or before 30 days before the date of said election. PART 2. That all of said applications shall be substantially in the following form: "To the Mayor of the City of San Marcos, Texas: I hereby request that my name be placed upon the official ballot for the election to be held on the 4th day of April, 1981, as a candidate for Place Council Member of said City. I hereby certify that-r am above the age of 18 years, a qualified elector and have resided 12 months next preceding said election in said City, and I am eligible to hold office under the Constitution of this State. That all candidates shall file with said application the loyalty affidavit required by Article 6.02 of the Election Code. PART 4. That the Secretary of this City shall, in accordance with the terms and provisions of Article 13.32 of the Election Code, post in her office the names of all candidates who have filed their applications in accordance with the terms and provisions of this order, and said names shall be posted at a conspicious place in said office for at least 10 days before said Secretary orders the same to beeprinted on the ballot for said election.
