<br /> 4. No permits shall be issued for any building, <br /> structure, or septic tank on a property for which a <br /> plat has not been approved and filed for record <br /> with the following exceptions: <br /> a. Permits for attached or detached single-family <br /> residences and duplexes constructed prior to <br /> March 10, 1975, where the permit is for <br /> accessory buildings, additions, remodeling, <br /> repair or demolition or for replacement of <br /> existing construction to be demolished. <br /> However, there shall be an approved and recorded <br /> plat prior to issuance of permits for new, non- <br /> replacement single-family homes or duplexes. <br /> b. Permits for multi-family residential or non- <br /> residential remodeling or repair which: <br /> 1. Do not result in building expansion; <br /> 2. Do not cause a change in use which results <br /> in increased impact on the city's <br /> infrastructure; and, <br /> 3. Are for buildings constructed prior to <br /> March 10, 1975. <br /> c. Demolition permits. <br /> SECTION 2. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 4. That Section C of Article IV of Appendix C- <br /> Subdivisions, of the San Marcos Code of Ordinances is hereby <br /> amended to read as follows: <br /> Section C. Penalty for violation of ordinance. <br /> <br /> (a) Any person who violates any provision of this <br /> ordinance shall be subject to a penalty in accordance with <br /> section 1-5 of this Code. <br /> (b) Prosecution for a violation of this ordinance shall <br /> not bar any other remedy available to the City for <br /> violations of this ordinance or of state laws pertaining to <br /> subdivisions. <br /> SECTION 5. That this Ordinance shall be in effect ten (10) <br /> days from and after its passage, and it shall be published in a <br /> newspaper of general circulation in the area as required by the <br /> Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading March 23, 1992. <br /> PASSED AND APPROVED on second reading April 13, 1992. <br /> PASSED, APPROVED AND ADOPTED April 27, 1992. <br /> Morris <br /> ~.~ <br />
