<br /> 17 <br /> ORDINANCE 1992- 36 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ESTABLISHING A NO PARKING TOW-AWAY <br /> ZONE ON THE SOUTH SIDE OF HOPKINS STREET: PROVIDING <br /> FOR SEVERABILITY: REPEALING ALL CONFLICTING <br /> ORDINANCES: PROVIDING A PENALTY: PROVIDING FOR <br /> PUBLICATION AND DECLARING AN EMERGENCY. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> SECTION 1. Tha t, pursuant to Section 29-44 of the San <br />Marcos Code of Ordinances, and Article 67Øld, V.T.C.S., <br />Section 95, a no parking tow-away zone, to be indicated by <br />official signs and entered in the traffic register, is hereby <br />established on the following street: <br /> Hopkins Street, south side, from its intersection with <br /> North Street east to a point 125 feet east of <br /> Comanche Street. <br /> SECTION 2. That if any word, phrase, sentence, section, <br />or portion of this ordinance is found by a court of competent <br />jurisdiction to be unconstitutional or unenforceable for any <br />reason, the remaining provisions of this ordinance shall <br />remain in effect. <br /> SECTION 3. That all ordinances or parts of ordinances <br />in conflict herewith are hereby repealed. <br /> SECTION 4. That any person violating any provision of <br />this ordinance shall be deemed guilty of a misdemeanor and <br />upon conviction shall be fined in accordance with Section 1-5 <br />of the San Marcos Code of Ordinances. <br /> SECTION 5. That the importance of this Ordinance <br />creates an emergency and an imperative public necessity so <br />that the provisions of the Charter requiring that ordinances <br />shall be presented at three separate meetings and that no <br />ordinance shall become effective until the expiration of ten <br />(lØ) days following the date of its final passage be <br />suspended, and these provisions are hereby suspended, and <br />this Ordinance shall take effect and be in full force and <br />effect from and after its adoption and after its publication <br />in a newspaper of general circulation within the City as <br />provided by the City Charter of the City of San Marcos~ <br />PASSED, APPROVED AND day of May, <br />1992. o~.~ <br />~st: i Approved: <br />- / 1L//l~ ' ,Øfi.rr~)-Z~ ~tA ' <br />Jf1is K.
