<br />-5- <br /> <br />Proposition No. 18 <br /> <br />The lease of the baseball/softball complex in the Ramon <br />Lucio Park to the Greater San Marcos Little League, Inc. <br />for the purpose of conducting baseball and softball games <br />under the Li ttle League's supervision, subj ect to the <br />following terms and conditions: <br /> <br />(1) In consideration of the construction and operation <br />by the League of a baseball/softball complex, <br />including five fields, concession stand, restrooms, <br />board room, storage facility, scoreboards, fencing, <br />lights, dugouts, scorekeeping stands, and bleachers <br />(the "Complex") at Ramon Lucio Park, City of San <br />Marcos, Hays County, Texas, City grants a lease of <br />the complex to the League for baseball/softball <br />games played under the supervision of the League. <br /> <br />(2) The League will have exclusive use of the <br />concession stand, restrooms, board room and storage <br />facili ty year round and may allow use of these <br />buildings by other programs with the League's <br />permission. The lease period for the remainder of <br />the Complex shall be from January 1 through August <br />15 of each year of the lease. The League may lease <br />the entire Complex for the remainder of each year <br />for a Fall baseball/softball program. The League <br />shall provide written notice of its intent to <br />conduct a Fall program to the City Parks and <br />Recreation Director not later than August 1 of each <br />year the program is to occur. <br /> <br />(3) The term of this lease shall be for a period of <br />twenty (20) years. <br /> <br />(4) This lease shall constitute the grant to the League <br />of an exclusive right to use the Complex from <br />January 1 to August 15 each year and for the <br />remainder of each year if a Fall program is <br />conducted. Practice sessions, League games, <br />associated League activities, and field preparation <br />may be scheduled during this period. The League <br />agrees that no inning in any game supervised by it <br />shall be allowed to begin after midnight for Big <br />League (ages 16-18) tournament games, or after <br />11:00 p.m. for all other games. <br /> <br />The League agrees that the Complex may be used for <br />other ci ty-sanctioned youth acti vi ties or League <br />approved youth activities during any Fall period <br />when the League is not the exclusive user, provided <br />that participants in these activities shall be 18 <br />years of age or younger, and have League approval. <br />The City shall repair any damage that occurs to the <br />Complex resulting from City-sanctioned activities. <br />Damages resulting from League sanctioned activities <br />will be repaired at the League's expense. <br /> <br />(5) The League agrees to maintain the Complex in a <br />condition suitable for the playing of <br />baseball/softball games from January 1 to August <br />15, and the remainder of the year should a Fall <br />program be conducted. It shall be the <br />responsibility of the League to deposit all refuse <br />from the Complex area in garbage refuse containers <br />provided by the City and to keep the Complex in a <br />sanitary and sightly condition at all times during <br />the period from January 1 to August 15 of each year <br />or year round if a Fall program is conducted.
