<br /> 45 <br /> RESOLUTION 1992 - 63 R <br /> A RESOLUTION OF THE CI'rY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS TO NOTIFY PARKVIEW METAL <br /> PRODUCTS, INC. OF DEFAULT UNDER A TAX <br /> ABATEMENT AGREEMENT; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City executed a Tax Abatement Agreement (the <br /> II Agreement ") with Parkview Metal Products, Inc. ("Parkview") on <br /> April lØ, 199Ø; and <br /> WHEREAS, Part II. B. of the Agreement calls for Parkview to <br /> have created lØØ year-round, full-time jobs by December 3l, 1991 <br /> at the new facility constructed by Parkview in San Marcos; and <br /> WHEREAS, Parkview has advised the City that it did not create <br /> this level of jobs by the deadline described above; and <br /> WHEREAS, Part V. A. of the Agreement calls for the City to <br /> notify Parkview in the event of a default of this nature, and to <br /> allow Parkview a period of sixty (6Ø) days to cure the default; <br /> now, therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the City Manager, Larry D. Gilley, is hereby <br /> directed to notify Parkview on behalf of the City Council of the <br /> above-described default by Parkview under the Agreement, and to <br /> request that Parkview take action to cure the default within sixty <br /> (6Ø) days from the date of the notice. This notice shall be given <br /> thirty (3Ø) days after the date of this Resolution. <br /> PART 2.
