69 STATE OF TEXAS SPECIAL WARRANTY DEED COUNTY OF HAYS The City of San Marcos, a municipal corporation, of Hays County, Texas, existing by and under the laws of the State of Texas, whose address is 630 East Hopkins, San Marcos, Texas, 78666 f or and in consideration of the sum of TEN DOLLARS ($10.00) and other good and valuable consideration to the undersigned paid the Grantee herein named, the receipt and sufficiency of which are hereby acknowledged, has GRANTED AND CONVEYED, and by these presents does GRANT AND CONVEY to Alton Hill, Marion Wills and Floyd Lackey and their successors and assigns as Trustees of the Westover Baptist Church, 1310 Advance Street, San Marcos, Texas, all of Grantor's right, title and interest in and to the following described real property in Hays County, Texas to-wit: An alley located in Block 40 of the Westover Addition to the City of San Marcos, Texas which abuts Lots 236-241 and Lots 262-267 in this addition, the plat of this addition being recorded in Volume 59, Pages 184-185 of the Deed Records of Hays County, Texas, the property herein conveyed being the entire width of the alley which abuts or is adjacent to property owned by the Trustees and their successors and assigns of the Westover Baptist Church. TO HAVE AND TO HOLD the above-described premises, together with all and singular the rights and appurtenances thereto in anywise belonging, unto the Grantees, their successors and assigns forever; and Grantor does hereby bind itself and its successors to warrant and forever defend all and singular the premises unto the Grantees, their successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under it, but not otherwise.
