70 THE STATE OF TEXAS RE LEASE COUNTY OF HAYS WHEREAS, the City of San Marcos, Texas, is considering the matter of vacating and abandoning a fifteen foot (15') by three hundred and fifteen foot (315') alley in Block 40 of the Westover Addition To The City Of San Marcos, that alley which abuts lots 236-241 and 262-267 of said addition of record in Vo 1 ume 59, Pages 184 and 185, Hays County Deed Records; and, WHEREAS, Robert F. Bagley, Artie McCarty, and Lola Petty and their successors and assigns, as Trustees of the Westover Baptist Church, are the owners of property abutting said alley, to-wit: Lots 236-241 and 262-267; and, WHEREAS, it is to the advantage of the said Robert F. Bag ley, Artie McCarty and Lola Pe t t Y and their successors and assigns, as Trustees of the Westover Baptist Church whose property abuts said alley in the Westover Addition For The City Of San Marcos and to the advantage of the public generally to abandon said alley; NOW, THEREFORE, in consideration of benefits to be received by Robert F. Bag ley, Artie McCarty and Lola Pe t ty and their successors and ass ig ns, as Trustees of the Westover Baptist Church and the general public, which are hereby acknowledged, the said Trustees of the Westover Baptist Church and their successors and assigns do hereby fully and forever release, acquit and discharge said City, its officers, successors and assigns, from any and all actions, causes of action, claims and demands of whatsoever kind or na ture on account of the vacation and abandonment of said alley in the Westover Addition To The City Of San Marcos, said alley having been more particularly described hereinabove.
