and within the boundaries of the Edwards Underground Water District, as such service area and boundaries may be redesignated by applicable law from time to time, as well as those customers being served pursuant to contracts enforceable on the date of this Agreement, and as such contracts may be renewed from time to time. It is expressly understood that the CITY shall not undertake to provide Aquifer Water or water paid for by the DISTRICT by contract to additional customers outside the CITY service area and DISTRICT boundaries during the term of this Agreement; provided that the City may treat and deliver to such additional customers surface water paid for solely by the City or by such customers so long as customer demand for water within the City service area and District boundaries is less than the minimum production level set forth in Paragraph 2.1. 2.6. Reports. The CITY will provide quarterly reports indicating the progress and operation of the Project and compliance by the CITY with its obligations in the form requested by the DISTRICT. The first such report shall be for the period ending March 31, 1993, and shall be provided to the DISTRICT within the thirty (30) business days of such date, and each report thereafter shall be provided to the DISTRICT within thirty (30) days of the end of each calendar quarter during the term of this contract. The DISTRICT may, at its sole option, waive the requirement in this subsection for quarterly reports. 2.7. Audits. 2.7.1. Financial Audits. The CITY agrees that the expenditure of funds by the CITY under this Agreement shall be audited, at the CITY's expense, as part of the annual audit performed on the CITY. The audit, with respect to the funds under this Agreement, shall be performed in accordance with the requirements of the DISTRICT. The audit report will include the CITY'S expenditures from funds provided by the DISTRICT for each fiscal year or portion thereof covered under this Agreement, and will be made available to the DISTRICT and its auditors not later than ninety (90) days after the end of each fiscal year or as soon thereafter as possible.
