<br /> and within the boundaries of the Edwards <br /> Underground Water District, as such <br /> service area and boundaries may be <br /> redesignated by applicable law from time <br /> to time, as well as those customers being <br /> served pursuant to contracts enforceable <br /> on the date of this Agreement, and as <br /> such contracts may be renewed from time <br /> to time. It is expressly understood that <br /> the CITY shall not undertake to provide <br /> Aquifer Water or water paid for by the <br /> DISTRICT by contract to additional <br /> customers outside the CITY service area <br /> and DISTRICT boundaries during the term <br /> of this Agreement; provided that the <br /> City may treat and deliver to such <br /> additional customers surface water paid <br /> for solely by the City or by such <br /> customers so long as customer demand for <br /> water within the City service area and <br /> District boundaries is less than the <br /> minimum production level set forth in <br /> Paragraph 2.1. <br /> 2.6. Reports. The CITY will provide quarterly <br /> reports indicating the progress and operation of the <br /> Project and compliance by the CITY with its obligations in <br /> the form requested by the DISTRICT. The first such report <br /> shall be for the period ending March 31, 1993, and shall <br /> be provided to the DISTRICT within the thirty (30) business <br /> days of such date, and each report thereafter shall be <br /> provided to the DISTRICT within thirty (30) days of the end <br /> of each calendar quarter during the term of this contract. <br /> The DISTRICT may, at its sole option, waive the requirement <br /> in this subsection for quarterly reports. <br /> 2.7. Audits. <br /> 2.7.1. Financial Audits. The CITY agrees <br /> that the expenditure of funds by the CITY <br /> under this Agreement shall be audited, at the <br /> CITY's expense, as part of the annual audit <br /> performed on the CITY. The audit, with <br /> respect to the funds under this Agreement, <br /> shall be performed in accordance with the <br /> requirements of the DISTRICT. The audit <br /> report will include the CITY'S expenditures <br /> from funds provided by the DISTRICT for each <br /> fiscal year or portion thereof covered under <br /> this Agreement, and will be made available to <br /> the DISTRICT and its auditors not later than <br /> ninety (90) days after the end of each fiscal <br /> year or as soon thereafter as possible. The <br /> CITY agrees to maintain all fiscal records and <br /> supporting documentation for a period of three <br /> (3) years after each audit has been accepted <br /> by the DISTRICT. <br /> 4. <br />
