4. GRANTS OF AUTHORITY: <br />a. For law enforcement purposes associated with this Agreement, officers of <br />the SMPD, KPD, BPD and TSUPD designated to be members of the Gang <br />Task Force are granted full peace officer authority throughout Hays <br />County. <br />b. For law enforcement purposes associated with the Agreement, officers of <br />the Sheriff s Office designated to be members of the Gang Task Force are <br />granted full peace officer authority within such portions of the City of San <br />Marcos, City of Kyle, City of Buda and Texas State University — San <br />Marcos and upon all property owned by San Marcos, Kyle and Texas <br />State University — San Marcos, which is situated outside of Hays County. <br />5. DESIGNATION OF GANG TASK FORCE: Designees to The Hays County Gang <br />Task Force (the*"HCGTF") shall be selected in the following manner: <br />a. From the Sheriffs office: Deputies and corresponding rank to be <br />determined by the Sheriff. <br />b. From the SMPD, KPD, BPD and TSUPD: Officers and corresponding <br />rank to be determined by the respective Chiefs of Police. <br />c. The Chiefs of Police and the Sheriff may change the number and <br />designation of personnel by written agreement signed by the Chiefs of <br />Police and the Sheriff. The San Marcos Police Chief, Kyle Police Chief, <br />Buda Police Chief, Texas State University — San Marcos Police Chief and <br />the Sheriff of Hays County shall jointly designate one member from the <br />above compliment to serve as the Gang Task Force Coordinator. HCGTF <br />personnel shall report to and be supervised by the Gang Task Force <br />Coordinator, who shall report jointly to the Hays County Sheriff, the San <br />Marcos Chief of Police, Kyle Chief of Police, Buda Chief of Police and <br />Texas State University — San Marcos Chief of Police. <br />6. STATUS OF PERSONNEL ASSIGNED TO THE TASK FORCE <br />a. Each entity shall be solely responsible for the conduct, alleged <br />misconduct, training, supervision discipline and control of the personnel <br />it assigns to the Hays County Gang Task Force while engaged in task <br />force activities. <br />b. Each entity shall be solely responsible for the wages, salaries, <br />pension, compensation, injury or death benefits, workers compensation <br />benefits, equipment, clothing, medical expenses, vehicles, travel, food <br />and lodging of the personnel it assigns to the Hays County Gang Task <br />Force. <br />c. If any person assigned to perform task force activities is cited as a party to <br />any civil lawsuit, state or federal, arising out of such activities, the person <br />shall be entitled only to the benefits, if any, provided by the entity which <br />employs that person. <br />7. HCGTF SUPERVISION: The day -to -day supervision of the HCGTF will be the <br />responsibility of the Gang Task Force Coordinator. Supervision and guidance of <br />2 <br />
