<br /> 92 <br /> RESOLUTION 1992 - 77 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS SUPPORTING THE PASSAGE <br /> OF LEGISLATION TO ALLOW HOME RULE CITIES TO <br /> REGULATE THE PUBLIC CONSUMPTION OF ALCOHOLIC <br /> BEVERAGES¡ AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the regular session of the 73rd Texas <br /> Legislature will convene on January 12, 1993¡ and <br /> WHEREAS, many cities across the state are plagued by <br /> problems of public safety and diminished economic development <br /> because of the inability to regulate possession and <br /> consumption of alcoholic beverages in public places¡ and <br /> WHEREAS, the Texas Alcoholic Beverage Code preempts <br /> local regulation of public possession and consumption of <br /> alcoholic beverage containers¡ <br /> \ffiEREAS, municipalities are better able to address <br /> alcohol-related problems of a local nature than the Texas <br /> Alcoholic Beverage Commission¡ and <br /> WHEREAS, the City of San Marcos would prefer that <br /> municipalities be allowed to regulate consumption of <br /> alcoholic beverages in public places¡ and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF SAN MARCOS: <br /> PART 1. That the City Council of the City of San Marcos <br /> supports passage of legislation in the Texas Legislature <br /> which would allow home rule municipalities to regulate <br /> consumption of alcoholic beverages in public places. <br /> PART 2. That the City Secretary, Janis K. Womack is <br /> directed to provide copies of this resolution to members of <br /> the Sunset Advisory Commission, Senator Kenneth Armbrister <br /> and Representative Libby Linebarger. <br /> PART 3.
