<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND
<br /> CONTAINING 51.62 ACRES, MORE OR LESS, FRONTING ON
<br /> THE SOUTHEAST RIGHT-OF-WAY LINE OF INTERSTATE
<br /> HIGHWAY 35 AT ITS INTERSECTION \VITH CENTER POINT
<br /> ROAD IN HAYS COUNTY, TEXAS, (LŒ-lMAN TRACT AND
<br /> CENTER POINT ROAD RIGHT-OF-WAY) THIS LAND BEING
<br /> LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF
<br /> THE CITY AND LYING ADJACENT TO PRESENT CITY
<br /> BOUNDARIES~ APPROVING A SERVICE PLAN FOR THIS
<br /> TRACT ~ EXTENDING THE BOUNDARY LIMITS OF THE CITY SO
<br /> AS TO INCLUDE THIS TRACT~ GRANTING TO THE
<br /> INHABITANTS OF THIS TRACT ALL THE RIGHTS AND
<br /> PRIVILEGES OF OTHER CITIZENS OF THE CITY~ BINDING
<br /> THE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES,
<br /> RULES AND REGULATIONS OF THE CITY~ AND DECLARING AN
<br /> EFFECTIVE DATE.
<br /> ~.vHEREAS, the City Council of the City of San Marcos, Texas,
<br />provided an opportunity for all interested persons to be heard at two
<br />(2) public hear ing s, held once on June 8, 1992 , and
<br />once on June 22, 1992 , to consider the proposed
<br />annexation by the City of San Marcos, Texas of 51.62 acres, more or
<br />less, of land fronting on the southeast right-of-way line of
<br />Interstate Highway 35 at its intersection with Center Point Road, Hays
<br />County, Texas, consisting of 49.39 acres owned by ~,1r. Al Lowman, and
<br />2.23 acres of right-of-way of Center Point Road, and being more
<br />particularly described by metes and bounds in attached Exhibit Ai and,
<br /> WHEREAS, an on-site public hearing has not been requested in
<br />writing by more than 2Ø adults residing in this area~ and,
<br /> WHEREAS, notices of these public hearings were published in the
<br />San Marcos Daily Record, a newspaper having general circulation in the
<br />City and in the territory proposed for annexation,
<br />on May 24, 1992 , and June 7, 1992 , these dates
<br />being not more than twenty (2Ø) days nor less than ten (lØ) days prior
<br />to the hearings for which notices were given~ and,
<br /> WHEREAS, prior to the publication of notices of these hearings,
<br />the City Council of the City of San Marcos, Texas directed preparation
<br />of a service plan that provides for the extension of municipal
<br />services to the area proposed for annexation~ and,
<br /> HHEREAS, the proposed service plan was made available for
<br />inspection and explained to the inhabitants of the area to be annexed
<br />at the public hearings~ and,
<br /> \vHEREAS, this 51.62 acre tract is contiguous and adjacent to the
<br />current boundaries of the City of San Marcos, Texas~ now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br /> SECTION 1. That that property more particularly described in
<br />Exhibit A which is attached hereto and incorporated herein for all
<br />purposes, being 51.62 acres of land adjoining the existing city limits
<br />of the City of San Marcos, Texas, fronting on the southeast
<br />right-of-way line of Interstate Highway 35 at its intersection with
<br />Center Point Road, Hays County, Texas, be, and the same is hereby,
<br />annexed to the City of San Marcos, Texas.
<br /> SECTION 2. That the Service Plan for thi s area, a copy of which
<br />is attached hereto as Exhibit B and incorporated herein for all
<br />purposes, is hereby approved.
<br /> SECTION 3. That the corporate limits of the City are hereby
<br />extended to include this described territory.
