~ 148 "..,. v-" - f:Q a --A :::::::> --:> ORDINANCE 1992- ~7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S ELECTRIC UTILITY TARIFFS TO ADD A RATE SCHEDULE COG FOR SPECIAL CONTRACT CUSTOMERS WHO OPERATE ELECTRIC GENERATION FACILITIES IN PARALLEL WITH THE CITY'S SYSTEM¡ PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES¡ PROVIDING FOR PUBLICATION; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the City of San Marcos Electric Utility Tariffs adopted by reference in section 9\-1 of Chapter 9\ of the San Marcos Code of Ordinances are hereby amended by adding a Rate Schedule COG in the form attached to this ordinance, consisting of six (6) pages, for special contract customers who operate electric generation facilities in parallel with the City's distribution system. SECTION 2. That all other provisions of the City of San Marcos Electric Utility Tariffs as previously adopted in Ordinance 1991-65 are hereby continued in full force and effect. SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 4. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 5. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
