176 RESOLUTION 1992- 99 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NUMBER 3 TO AN AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND THE UNITED STATES DEPARTMENT OF AGRICULTURE SOIL CONSERVATION SERVICE: AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NUMBER 3 ON BEHALF OF THE CITY: AND DECLARING AN EFFECTIVE DATE. WHEREAS, on September 26, 199Ø the City of San Marcos entered into an agreement with the United States Department of Agriculture Soil Conservation Service (SCS) for improvements to City recreation facilities in the Upper San Marcos River Watershed (Project Agreement No. 69-7442-Ø-99): and, ~vHEREAS, on March 23, 1992 the City approved Amendment No.2 to the original agreement which extended the performance time to August 31, 1992: and, WHEREAS, it is necessary to amend the Agreement to increase the performance time of the original agreement: now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That Amendment No.3 to that original agreement between the City and SCS, a copy of which is attached hereto and incorporated herein for all intents and purposes, is hereby approved. PART 2. That the City Manager, Larry D. Gilley, is authorized to execute Amendment No.3 on behalf of the City. PART 3. That this Resolution shall be in full force and effect from and after its passage.
