<br /> 6 <br /> ('$' <br /> 0 <br /> ORDINANCE 1992- 63 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, ADOPTING A BUDGET FOR <br /> THE FISCAL YEAR BEGINNING ON OCTOBER 1, 1992 <br /> AND ENDING ON SEPTEMBER 30, 1993, REPEALING <br /> ALL ORDINANCES IN CONFLICT WITH THIS <br /> ORDINANCE; AUTHORIZING TRANSFERS OF FUNDS <br /> WITHIN DEPARTMENTS WITH THE APPROVAL OF THE <br /> CITY MANAGER, AND DECLARING AN EMERGENCY. <br /> WHEREAS, the Charter of the City of San Marcos, Texas provides <br /> that the City council shall set a time and place of public hearing <br /> on the proposed budget for the City and shall cause notice of the <br /> hearing and a summary of the budget to be published in one or more <br /> newspapers of general circulation in the City; and, <br /> WHEREAS, the City Council at its regular meeting on <br /> July 27,1992 ,set the date of this hearing and directed the <br /> notice and budget summary be published; and, <br /> WHEREAS, the notice and budget summary were published in at <br /> least one newspaper of general circulation in the City on <br /> July 30,1992 ,a date at least ten (10) days prior to the date <br /> set for the public hearing on the budget for the City for the <br /> fiscal year beginning October 1, 1992 and ending September 30, <br /> 1993; and, <br /> WHEREAS, the public hearing on the budget was held on <br /> 7'ugust 10, 1992 ,a time at which all interested persons were <br /> given an opportunity to be heard for or against any item or the <br /> amount of any item contained in the budget; and, <br /> WHEREAS, at least fourteen (14) days have elapsed since the <br /> public hearing on the budget as required by the City Charter; and, <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the city of San Marcos Operating and Capital <br /> Budget, Fiscal Year 1992-93, as shown in words and figures therein <br /> is hereby approved and adopted for the fiscal year beginning <br /> October 1, 1992 and ending September 30, 1993. <br /> SECTION 2. That there is hereby appropriated the amount shown <br /> in the city of San Marcos Operating and Capital Budget, Fiscal Year <br /> 1992-93 necessary to provide for a sinking fund for the paYment of <br /> the principal and interest and the retirement of the bonded debt of <br /> the City. <br /> SECTION 3. That fund transfers among the accounts within each <br /> department, and reclassification of positions within each <br /> department, may be made with the approval of the City Manager. <br /> SECTION 4. That should any part, portion, or section of this <br /> ordinance be declared invalid or inoperative or void for any reason <br /> by a court of competent jurisdiction, such decision, opinion or <br /> judgment shall in no way affect the remaining portions, parts, or <br /> sections or parts of a section of this ordinance, which provisions <br /> shall be, remain and continue to ~ in full force and effect. <br /> SECTION 5. That all ordinances and appropriations for which <br /> provision has heretofore been made are hereby expressly repealed if <br /> in conflict with the provisions of this ordinance. <br /> SECTION 6. That the importance of this Ordinance creates an <br /> emergency and an imperative public necessity so that the provisions <br /> of the Charter requiring that ordinances shall be presented at <br /> three separate meetings and that no ordinance shall become <br />
