'-0 IL~ ::-,; c:;: 14 ORDINANCE 1992- 65 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX G, HISTORICAL ZONING ORDINANCE, OF THE SAN MARCOS CODE OF ORDINANCES TO DECREASE THE TERMS OF OFFICE AND TO STAGGER THE TERMS OF MEMBERS OF THE CITY HISTORIC PRESERVATION COMMISSION; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Historic Preservation Commission has conducted a public hearing and has recommended the adoption of an ordinance amending the city Historical Zoning Ordinance, Appendix G of the San Marcos Code of Ordinances, in order to reduce the length of terms of office and provide for staggered terms of the members of the Commission; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 5 of Appendix G, Historical Zoning Ordinance, of the San Marcos Code of Ordinances is hereby amended to read as follows: Section 5. Terms of Office. (a) The six (6) members appointed by the city Council shall serve three (3) year staggered terms, with the terms of two members expiring on the date of the first regular city Council meeting in January each year. (b) The member appointed QY the Planning commission shall serve a one (1) year term which shall expire on the date of the first regular Planning commission meeting in November. (c) An appointment to fill a vacancy shall be for the unexpired term. SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 3. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 4. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
