<br /> <br />,c; <br />~ <br />~'r; <br /> <br />\ ..... <br />'-0 <br />IL~ <br />::-,; <br />c:;: <br /> <br /> <br />14 <br /> <br />ORDINANCE 1992- 65 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING APPENDIX G, <br />HISTORICAL ZONING ORDINANCE, OF THE SAN MARCOS <br />CODE OF ORDINANCES TO DECREASE THE TERMS OF <br />OFFICE AND TO STAGGER THE TERMS OF MEMBERS OF <br />THE CITY HISTORIC PRESERVATION COMMISSION; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Historic Preservation Commission has <br />conducted a public hearing and has recommended the adoption of an <br />ordinance amending the city Historical Zoning Ordinance, Appendix <br />G of the San Marcos Code of Ordinances, in order to reduce the <br />length of terms of office and provide for staggered terms of the <br />members of the Commission; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 5 of Appendix G, Historical Zoning <br />Ordinance, of the San Marcos Code of Ordinances is hereby amended <br />to read as follows: <br /> <br />Section 5. Terms of Office. <br /> <br />(a) The six (6) members appointed by the city Council <br />shall serve three (3) year staggered terms, with the terms <br />of two members expiring on the date of the first regular <br />city Council meeting in January each year. <br /> <br />(b) The member appointed QY the Planning commission shall <br />serve a one (1) year term which shall expire on the date of <br />the first regular Planning commission meeting in November. <br /> <br />(c) An appointment to fill a vacancy shall be for the <br />unexpired term. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 4.
