<br /> <br />rJ <br />...:s- <br />e:;- <br /> <br />16 <br /> <br /> <br />..i::~ <br />'-..) <br /> <br />ORDINANCE 1992- 67 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 12-8 OF <br />THE SAN MARCOS CODE OF ORDINANCES TO PROVIDE <br />FOR SETTING OF THE RESIDENTIAL SOLID WASTE <br />COLLECTION RATE, AND OF THE PORTION OF SUCH <br />RATE TO BE DEPOSITED INTO THE SOLID WASTE <br />RESERVE FUND, BY SEPARATE ORDINANCE: <br />DECREASING THE RESIDENTIAL SOLID WASTE <br />COLLECTION RATE BASED ON THE CONTRACT <br />COLLECTION RATE FOR BROWNING-FERRIS <br />INDUSTRIES, INC.: SETTING THE AMOUNT OF THE <br />SOLID WASTE COLLECTION RATE TO BE DEPOSITED <br />INTO THE SOLID WASTE RESERVE FUND: PROVIDING <br />FOR SEVERABILITY: REPEALING ALL CONFLICTING <br />ORDINANCES: PROVIDING FOR PUBLICATION: AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />~ <br />~ <br /> <br />WHEREAS, a decrease of the rate in the City's solid waste <br />collection contract with Browning-Ferris Industries, Inc. makes <br />possible a corresponding decrease in the City's solid waste collection <br />rate charged to residents: now therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That subsections (a) and (e) of Section 12-8 of the <br />San Marcos Code of Ordinances are hereby amended to read as follows: <br /> <br />(a) The monthly charge for the collection of garbage and rubbish <br />from each residential unit located in the city using bags and <br />containers shall be established by separate ordinance from <br />time to time by the City Council. <br /> <br />(e) A solid waste reserve ~und shall be established by the <br />director of finance. The funds deposited in this account are <br />to be used for purposes related to the collection or disposal <br />of solid waste. From each monthly residential unit payment, <br />the director of finance shall cause a portion of the payment, <br />in an amount set by separate ordinance from time to time by <br />the City Council, to be deposited into the reserve fund. <br /> <br />SECTION 2. That, pursuant to Section 12-8 (a) of the San Marcos <br />Code of Ordinances, the monthly charge for the collection of garbage <br />and rubbish from each residential unit located in the city using bags <br />and containers shall be $8.04. <br /> <br />SECTION 3. That, pursuant to Section 12-8 (e) of the San Marcos <br />Code of Ordinances, the amount of each monthly residential unit payment <br />to be deposited into the solid waste reserve fund is set at 239. <br /> <br />SECTION 4. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or invalid <br />by a court of competent jurisdiction, the remaining provisions of this <br />ordinance shall remain in effect as if the unconstitutional or invalid <br />portion had not been adopted. <br /> <br />SECTION 5. That all ordinances or parts of ordinances in conflict <br />with this ordinance are hereby repealed. <br /> <br />SECTION 6. That this Ordinance shall apply to billing cycles <br />initiated by the City for said waste collection and disposal services <br />on and after October 1, 1992, and it shall be published in a newspaper <br />of general circulation in the area as required by the Charter of the <br />City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading August 24, 1992. <br /> <br />PASSED AND APPROVED on second reading September 8, 1992. <br />
