Ken Long asked Mr. Kilber <br />what happens if the sanitation contractor defaults, and Mr. Kilber <br />explained there was a provision in the contract for this. Dr. Long <br />stated he favored the Contract. Mayor Craddock stated the Martindale <br />site that had been considered in the past was usable but would be in- <br />volved in litigation, and that time would not permit a continuance of <br />looking for a landfill site. She said a commercial sanitation con- <br />tractor seemed the most reasonable method for the citizens. Shirley <br />Wickersham stated there were approximately 3,800 people outside the <br />city limits who presently used the landfill and that many citizens <br />within the city presently used the landfill to personally haul debris. <br />Mr. Kilber stated a commercial sanitation contractor could make arrange- <br />ments to take care of the needs of the surrounding area or they could <br />option to use the New Braunfels' landfill. Mr. Kreczmer expressed a <br />concern for the City handling the billing and collection for a sanita- <br />tion contract, and City Manager Gonzalez said the City had more leverage <br />for payment from the customers with the three combined utility serVlces <br />of water, sewage and garbage, and that it was far more economical for <br />the City to be responsible for the collection than a contractor. Mr. <br />Kreczmer also stated he would like to see the City's equipment removed <br />from the contract. Mr. Kilber said having the equipment in the contract <br />gave the City an option to receive bids from the contractors that the <br />City could review and sellon a piece by piece bid if the City felt the <br />bid was acceptable. Dr. Long said he appreciated Mr. Kilber trying to <br />produce realistic figures for the Council's consideration and appreciated <br />the Council trying to make long-range plans. Mayor Craddock closed the <br />public hearing. <br /> <br />Mayor Craddock introduced for consideration authorization to bid the <br />sanitation contract. Mr. Farr moved authorization to bid the contract <br />with one change to be made on Page 36 of the contract under 13.04 (a), <br />the second sentence to read: "The City shall give notice to discontin- <br />ue service only upon receiving a request from the Residential Producer <br />to close his account or upon the failure of the Residential Producer to <br />pay his utility account in a timely manner." Mrs. Norris seconded the <br />motion, which passed unanimously. <br /> <br />In conjunction with the above authorization to bid the sanitation con- <br />tract, Kelly Kilber requested the Council give permission for the equip- <br />ment to be bid separately, as well as in the contract.
