Taylor City Attorney City of San Marcos 630 Hopkins San Marcos, Texas 78666 Re: Representation by Haynes and Boone Dear Mark: Thank you for your letter of August 19 I inviting us to submit a proposal for assisting the City in connection with civil service proceedings to be initiated by the Fire Chief against one of the civil service employees. We are pleased to assist the City and the Fire Chief in this matter. As you know, we have assisted several cities in similar matters. Our assistance to the City of San Marcos would include counseling with City officials, including the Chief, as to the advisability of the proposed discipline, assisting in drafting and/or reviewing any disciplinary letter which may be sent to the employee, advising on procedural steps in the event of an appeal and presenting the Chief's case to a fact finder, if an appeal is taken by the employee. Our practice is to charge our clients based upon the amount of time involved in assisting at the various stages of this proceeding. My time is billed at a special public sector rate of $145 per hour. If I were required to utilize the services of any of the associates who work with me, their time is billed on an hourly basis in a range from $85 to $105 per hour. We also bill expenses, such as travel, telephone, telecopy and photocopying, separately. As you might expect, it is impossible to predict in advance what the total attorneys' fees might be in a civil service disciplinary matter. Where an
