Taylor <br />City Attorney <br />City of San Marcos <br />630 Hopkins <br />San Marcos, Texas 78666 <br /> <br />Re: Representation by Haynes and Boone <br /> <br />Dear Mark: <br /> <br />Thank you for your letter of August 19 I inviting us to <br />submit a proposal for assisting the City in connection with <br />civil service proceedings to be initiated by the Fire Chief <br />against one of the civil service employees. We are pleased to <br />assist the City and the Fire Chief in this matter. As you <br />know, we have assisted several cities in similar matters. <br /> <br />Our assistance to the City of San Marcos would include <br />counseling with City officials, including the Chief, as to the <br />advisability of the proposed discipline, assisting in drafting <br />and/or reviewing any disciplinary letter which may be sent to <br />the employee, advising on procedural steps in the event of an <br />appeal and presenting the Chief's case to a fact finder, if an <br />appeal is taken by the employee. <br /> <br />Our practice is to charge our clients based upon the <br />amount of time involved in assisting at the various stages of <br />this proceeding. My time is billed at a special public sector <br />rate of $145 per hour. If I were required to utilize the <br />services of any of the associates who work with me, their time <br />is billed on an hourly basis in a range from $85 to $105 per <br />hour. We also bill expenses, such as travel, telephone, <br />telecopy and photocopying, separately. As you might expect, it <br />is impossible to predict in advance what the total attorneys' <br />fees might be in a civil service disciplinary matter. Where an <br />
