<br />Page 4 <br /> <br />herein, in accordance with the budget approved by the city. <br /> <br />C. Chamber shall obtain the advice and counsel of the EDC as <br /> <br />to the hiring and firing of management-level Chamber employees <br /> <br />responsible for EDC activities. <br /> <br />D. Chamber shall not discriminate against any person, firm or <br /> <br />organization in connection with this Agreement on the basis of <br /> <br />inability to pay, age, sex, disability, race, nationality, or <br /> <br />religion. <br /> <br />E. Chamber shall not assign any interest in this Agreement <br />nor delegate the performance of any of its duties without the prior <br />written consent of City and EDC. <br /> <br />IV. <br />OBLIGATIONS OF THE CITY <br /> <br />A. The City shall pay to the EDC and the Chamber, jointly, <br />the sum of $80,000.00 not later than December 31, 1992. <br /> <br />B. Prior to any continuation or renewal of this Agreement, <br /> <br />the City shall have the right to conduct a performance review of <br /> <br />EDC and Chamber acti vi ty under this Agreement. <br /> <br />The following <br /> <br />standards shall be used in measuring such performance: <br /> <br />1. The Dollar amount of development investments <br />attracted through EDC activity. <br /> <br />2. The number of new employees that are committed to <br />be employed by development attracted through EDC <br />activity. <br /> <br />3. The number of new prospect contacts and site <br />visits. <br /> <br />4. The number of existing employees whose positions <br />are retained against probable loss directly as a <br />result of EDC and Chamber activity. <br />
