ORDINANCE 1992- 71 <br />~ 0 <br /> C- '8 <br /> u.J ~I AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> en <br /> a.t CITY OF SAN MARCOS, TEXAS, ESTABLISHING <br /> A NO PARKING TOW-AHAY ZONE ON THE WEST <br /> SIDE OF MOON STREET¡ PROVIDING FOR <br /> SEVERABILITY¡ REPEALING ALL CONFLICTING <br /> ORDINANCES¡ PROVIDING A PENALTY¡ <br /> PROVIDING FOR PUBLICATION AND <br /> ESTABLISHING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> Section 1. Tha t, pursuant to Section 29-44 of the San <br /> Marcos Code of Ordinances, and Article 67Øld, V.T.C.S.; <br /> section 95, a no parking tow-away zone, to be indicated by <br /> official signs and entered in the traffic register; is hereby <br /> established on the following street: <br /> Moon Street, 3ØØ Block, West side; from its intersection <br /> with University Drive, to its intersection with <br /> Hutchison Street. <br /> section 2. That if any word; phrase, sentence, section, <br /> or portion of this ordinance is found by a court of competent <br /> jurisdiction, to be unconstitutional or unenforceable fòr any <br /> reason, the remaining provisions of this ordinance shall <br /> remain in effect. <br /> section 3. That all ordinances or parts of ordinances <br /> in conflict herewith are hereby repealed. <br /> Section 4. That any person violating any provision of <br /> this ordinance shall be deemed guilty of a misdemeanor and <br /> upon conviction shall be fined in accordance with Section 1-5 <br /> of the San Marcos Code of Ordinances. <br /> Section 5. That this Ordinance shall be in effect ten <br /> (lØ) days from and after its passage, and it shall be <br /> published in a newspaper of general circulation in the area <br /> as required by the Charter of the City of San Marcos; Texas. <br /> PASSED AND APPROVED on first reading September 14, 1992. <br /> PASSED fu~D APPROVED on second reading September 28, 1992. <br /> PASSED, APPROVED AND ADOPTED Oc 0 er 12, 1992. . <br /> M.
