<br /> 74 <br /> RESOLUTION 1992 - 123 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS; TEXAS APPROVING THE TERMS AND <br /> CONDITIONS OF STANDARD UTILITY AND JOINT USE <br /> AGREEMENTS BETWEEN THE CITY AND THE TEXAS <br /> DEPARTMENT OF TRANSPORTATION FOR RELOCATION OF <br /> SAN MARCOS ELECTRIC UTILITY FACILITIES IN <br /> CONNECTION WITH THE IH-35 WIDENING PROJECT <br /> BETI~EEN STATE HIGHWAY 123 AND THE COMAL COUNTY <br /> LINE¡ AUTHORIZING THE CITY MANAGER TO EXECUTE <br /> THE AGREEMENTS ON BEHALF OF THE CITY¡ AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the Texas Department of Transportation and the City <br /> wish to enter into a Standard Utility Agreement and a Joint Use <br /> Agreement regarding the relocation of San Marcos Electric Utility <br /> facilities in connection with the widening of IH-35 between State <br /> Highway 123 and the Comal County line¡ now, therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS; <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Standard <br /> Utility and Joint Use Agreements attached to this Resolution <br /> between the City and the Texas Department of Transportation for <br /> the IH-35 widening project between State Highway 123 and the 'Comal <br /> County line are hereby approved. " <br /> PART 2. That the City Manager~ Larry D. Gilley is hereby <br /> authorized to execute these Agreements on behalf of the City. <br /> PART 3.
