OF SAN MARCOS, TEXAS, DECREASING THE <br />RESIDENTIAL SOLID WASTE COLLECTION RATE; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR <br />PUBLICATION; AND DECLARING AN EMERGENCY. <br /> <br /> <br />WHERKlI"S, the suspension of recycl ing services. due to the <br />finalization of the City's contract with Waste Management, Inc. makes <br />possible a corresponding decrease in the City's solid waste collection <br />rate charged to residents; now therefore; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That, pursuant to Section 12-8 (a) of the San Marcos <br />Code of Ordinances, the monthly charge for the collection of garbage <br />and rubbish from each residential unit located in the city using bags <br />and containers shall be $6.33. <br /> <br />SECTION 2. That, pursuant to Section 12-8 (e) of the San Marcos <br />Code of Ordinances, the amount of each monthly residential unit payment <br />to be deposited into the solid waste reserve fund is set at 23ç. <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or invalid <br />by a court of competent jurisdiction, the remaining provisions of this <br />ordinance shall remain in effect as if the unconstitutional or invalid <br />portion had not been adopted. <br /> <br />SECTION 4. That all ordinances or parts of ordinances in conflict <br />with this ordinance are hereby repealed. <br /> <br />SECTION 5. That thi s Ordinance shall apply to billing cycles <br />initiated by the City for said waste collection and disposal serVlces <br />on and after November 1, 1992. , <br /> <br />SECTION 6. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (lØ) days following the date of its final passage <br />be suspended, and these provisions are hereby suspended, and this <br />Ordinance shall take effect and be in full force and effect from and <br />after its adoption and after its p~blication in a newspaper of general <br />circulation within the City as provided by the City Charter of the City <br />of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 26th day of October, <br /> <br />1992. ~ if\A.~ <br />Lt~~~ Morris <br />. ~~~~v M.
