RESOLUTION NO. 13 m 146 OF THE SAN ANTONIO WATER SYSTEM BOARD OF TRUSTEES APPROVING AN INTERLOCAL AGREEMENT FOR COOPERATIVE PURCHASING BETWEEN THE SAN ANTONIO WATER SYSTEM AND THE CITY OF SAN MARCOS; AUTHORIZING THE PRESIDENT /CHIEF EXECUTIVE OFFICER OR HIS DULY APPOINTED DESIGNEE TO EXECUTE THE INTERLOCAL AGREEMENT; FINDING THE RESOLUTION TO HAVE BEEN CONSIDERED PURSUANT TO THE LAWS GOVERNING OPEN MEETINGS; PROVIDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the San Antonio Water System (the "System") has investigated the possibility of entering enter into cooperative procurements as a procurement tool that could result in savings to the System; and WHEREAS, both the System and the City of San Marcos desire to enter into an Interlocal Agreement for Cooperative Purchasing pursuant to the Interlocal Cooperative Act, Chapter 791.011 of the Texas Government Code and Section 271.102 of the Texas Local Government Code, whereby both entities may cooperate in purchasing various items; and WHEREAS, the Agreement will be for a term of one year and will be automatically renewed for additional one year periods until terminated by either party; and WHEREAS, the San Antonio Water System Board of Trustees desires (i) to approve an Interlocal Agreement for Cooperative Purchasing with the City of San Marcos for Cooperative Procurement Contracting, and (ii) to authorize the President /Chief Executive Officer or his duly appointed designee to execute the Interlocal Agreement; now, therefore; BE IT RESOLVED BY THE SAN ANTONIO WATER SYSTEM BOARD OF TRUSTEES: 1. That an Interlocal Agreement for Cooperative Purchasing between the San Antonio Water System and the City of San Marcos for Cooperative Purchasing in substantially the form attached as Attacl-unent I hereto is hereby approved.. 2. That the President /Chief Executive Officer or his duly appointed designee is hereby authorized to execute the Interlocal Agreement. 3. It is officially found, determined and declared that the meeting at which this resolution is adopted was open to the public, and that public notice of the time, place and subject matter of the public business to be conducted at such meeting, including this resolution, was given to all as required by the Texas Codes Annotated, as amended, Title 5, Chapter 551, Government Code.
