<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br /> ZONING MAP OF THE CITY BY ZONING LOT 4, OUT OF
<br /> THE LERNMOR SUBDIVISION III IN THE CITY OF SAN
<br /> MARCOS, TEXAS, AS RECORDED IN VOLUME 3, PAGE
<br /> 97 OF THE HAYS COUNTY PLAT RECORDS, LOCATED AT,
<br /> 103 MOSSCLIFF DRIVE FROM "C" COMMERCIAL
<br /> DISTRICT TO "MF-3" MULTI-FAMILY DISTRICT (HIGH
<br /> DENSITY) AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on September 1, 1992, the zoning commission of the
<br /> city of San Marcos held a public hearing regarding a request to
<br /> change the zoning from IIC" Commercial District to IIMF-3" Multi-
<br /> Family District (High Density) for Lot 4, out of the LernMor
<br /> Subdivision III in the city of San Marcos as recorded in Volume 3,
<br /> Page 97 of the Hays County Plat Records, located at 103 Mosscliff
<br /> Drive; and,.
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br /> Zoning commission did, on September 1, 1992 consider the request
<br /> and voted to approve it and has recommended that the request be
<br /> approved by the city Council of the city; and,
<br /> ~
<br /> WHEREAS, the City Council held a public hearing on the 9th
<br /> day of November, 1992, regarding the request; and,
<br /> WHEREAS, all requirements of Appendix A, General zoning
<br /> Ordinance, of the Code of Ordinances of the City of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, the city Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the
<br /> public health, morals, welfare and safety; now, therefore,

<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the Official Zoning Map of the city, as
<br /> described in section 3 of the General Zoning Ordinance is hereby
<br /> amended to rezone the following described real property located in
<br /> San Marcos, Hays County, Texas, which is presently zoned "C"
<br /> Commercial District to IIMF-311 Multi-Family District (High Density)
<br /> to:
<br /> LOT 4, OUT OF THE LERNMOR SUBDIVISION III IN THE CITY OF
<br /> SAN MARCOS, TEXAS, AS RECORDED IN VOLUME 3, PAGE 97 OF
<br /> THE HAYS COUNTY PLAT RECORDS.
<br /> SECTION 2. That this Ordinance shall be in effect ten (10)
<br /> days from and after its passage and after it has been subject to
<br /> reconsideration by the Council at its next regular meeting
<br /> following its passage, and providing that the Council did not vote
<br /> to reconsider it. If reconsidered on November 23, 1992it shall be
<br /> in effect ten days from and after its passage on that date if
<br /> approved. It shall not go into effect if denied. If not
<br /> reconsidered and approved it shall be published in a newspaper of
<br /> general circulation in the area as required by the Charter of the
<br /> city of San Marcos, Texas.
<br /> PASSED, APPROVED AND ADOPTED this 9th day of November, 1992,
<br /> subject to reconsideration at the next regular City Council meeting
<br /> scheduled forNovember 23, 1992 .
