MARCOS, TEXAS, ELIMINATING THE PERSONNEL APPEALS <br />~ Ò ..... ! t3! BOARD; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />- pj ~'3 CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION <br />u.. ~ CS ë:.S: AND PROVIDING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That section 2-28, persònnel Appeals Board, and <br />section 2-29, Personnel Appeal Procedure, of the San Marcos Code of <br />Ordinances are hereby repealed. <br /> <br />SECTION 2. That section 2-93(c) (3) of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> <br />(3) The Commission shall recommend to appropriate <br />authorities cases for prosecution. In the case of the <br />mayor, a council member, a member of a city board or <br />commission, or an employee who is a council appointee, <br />a copy of the recommendation shall be provided to the <br />city council. In the case of employees who are not <br />council appointees, a copy of the recommendation shall <br />be provided to the city manager. <br /> <br />SECTION 3. That section 2-27 of the San Marcos Code of <br />Ordinances is hereby amended t~ read as follows: <br /> <br />Sec. 2-27 Division of employment. <br /> <br />(a) All city emploYment positions, except for fire <br />fighters and police officers subject to civil service <br />regulations, are to be divided between those which are <br />exempt from payment of overtime (exempt positions), and <br />those which are not exempt from payment of overtime (non- <br />exempt positions). <br /> <br />(b) Exempt positions shall include: <br /> <br />(1) positions filled by city council appointment; <br />and <br /> <br />(2) positions in salary grades 41-48 of the city <br />employee classification schedule. <br /> <br />(c) Non-exempt positions shall include positions in <br />salary grades 11-19 of the city employee classification <br />schedule. <br /> <br /> <br />SECTION 4. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 5. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 6. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading October 26, 1992. <br /> <br />PASSED AND APPROVED on second reading November 9, 1992. <br />
