AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, GENERAL OBLIGATION BONDS, SERIES 1992-A, IN THE AGGREGATE PRINCIPAL AMOUNT OF $4,600,000; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE SECURI:rY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE ,- THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY WHEREAS, by vi rtue of an election held within the City of San Marcos, Texas (the "City") on May 2, 1992, this City Council (the or this "City Council") became authorized to issue, sell and deliver $4,600,000 general obligation bonds of the City for the purposes hereinafter set forth; and WHEREAS, this City Council finds and determines that it is necessary and in the best interest of the Ci ty and its citizens at this time to authorize the issuance and delivery of all of such bonds in a single issue, in accordance with the Constitution and laws of the State of Texas, including Article 1175, Tex. Rev. Civ. Stat. Ann., as amended, and the Home Rule Charter ôf the City; Now, Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: ARTICLE I DEFINITIONS AND OTHER PRELIMINARY MATTERS Section 1. 01. Definitions. Unless otherwise expressly provided or unless the context clearly requires otherwise, in this Ordinance the following terms shall have the meanings specified below: . "Bond" means any of the Bonds. "Bonds" means the City's bonds entitled "City of San Marcos, Texas, General Obligation Bonds, Series 1992-A" authorized to be issued by Section 3.01 of this Ordinance. "Closing Date" means the date of the initial delivery of and payment for the Bonds. "Code" means the Internal Revenue Code of 1986, as amended, including applicable regulations, published rulings and court decisions relating thereto.
