ORDINANCE 1992- 87 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING 4.62 ACRES, MORE OR LESS, LOCATED IN RIO VISTA PARK ALONG. THE 300 BLOCK OF C.M. ALLEN PARKWAY AND THE 500 BLOCK OF CHEATHAM STREET FROM "MF-4" MULTI-FAMILY DISTRICT (HIGH DENSITY) TO "P" PUBLIC AND INSTITUTIONAL DISTRICT AND DECLARING AN EFFECTIVE DATE. WHEREAS, on October 6,1992, the zoning commission of the city of San Marcos held a public hearing regarding a request to change the zoning from "MF-4" Multi-Family District (High Density) to "P" Public and Institutional District of 4.62 acres located in Rio vista Park along the 300 Block of C.M. Allen Parkway and 500 Block of Cheatham Street; and, WHEREAS, subsequent to the public hearing on that date, the zoning Commission did, on October 6, 1992 consider the request and voted to approve it and has recommended that the request be approved 'by the City Council of the City; and, ~ WHEREAS, the city Council held a public hearing on the 7Tn day of December, 1992, regarding the request; and, WHEREAS, all requirements of Appendix A, General zoning Ordinance, of the Code of Ordinances of the city of San Marcos pertaining to amendments have been met; and, WHEREAS, the City Council hereby finds and determines that the adoption of the following ordinance' is in the interest of the public health, morals, welf~re and safety; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Official zoning Map of the city, as described in section 3 of the General Zoning Ordinance is hereby amended to rezone the following described real property located in San Marcos, Hays County, Texas, which is presently zoned "MF-4" Multi-Family District (High Density) to "P" Public and Institutional District: Beginning at the intersection of the Eastern right-of-way line of C.M. Allen Street and the Northern right-of-way line of Cheatham Street; then following the Northern right-of-way line of Cheatham Street in an Easterly direction to the point where such line intersects the Southeastern corner of Lot 1, Block 4 of Katy Addition as shown on the plat thereof recorded in Volume 34, Page 117 of the Hays County Deed Records; then following the Eastern lot lines of Lots 1 through 9, inclusive, of Block 4 of Katy Addition in a northerly direction to the point where the northeastern corner of Lot 9, Block 4 of the Katy Addition intersects the Southern railroad right- of-way line; then following the Southern railroad right- of-way line in a southwesterly direction to the point where such right-of-way line intersects the Eastern right-of-way of C.M. Allen Street; then following the Eastern right-of-way line of C.M. Allen Street in a Southerly direction to the point of beginning, containing 4.62 acres, more or less. SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its passage and after it has been subject to reconsideration by the Council at its next regular meeting
