<br />i! :;;. !i lit: 6 <br />. -::Sr 2\ <br />" ~ t:i:f <br />111 N C::::s;¡ <br />U~~ ~t5 ORDINANCE 1992 - 88 <br />-- E:....) êi <br />IL~ ~ ~b <br /> <br />.96 AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING THE <br />CITY'S ELECTRIC UTILITY TARIFFS TO CHANGE <br />THE WORD ING " CUSTOMER CHARGE" TO " BAS I C <br />SERVICE" FOR ALL RATES; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING FOR PUBLICATION AND <br />DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the San Marcos Electric Utility Board has <br />recommended that the City's Electric Utility Tariffs be <br />amended to change the wording "customer charge" to "basic <br />service II for all rate schedules in order to allow customers a <br />better understanding of charges on monthly utility billings; <br />now, therefore <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That the San Marcos Electric Utility Tariffs <br />attached to this ordinance as Exhibit "A" are hereby adopted <br />as if set out at length herein, pursuant to Section 9 1/2-1 <br />of the San Marcos Code of Ordinances. <br />~ <br />SECTION 2. Severability: It is hereby declared to be <br />the intention of the City Council that the sections, <br />paragraphs, sentences, clauses and phrases of this Ordinance <br />are severable, and if any phrase, clause, sentence, paragraph <br />or section of this Ordinance shall be declared <br />unconstitutional by the valid judgment or decree of any court <br />of competent jurisdiction, such unconstitutionality shall not <br />affect any of the remaining phrases, clauses, sentences, <br />paragraphs and sections of this. Ordinance, since the same <br />would have been enacted by the City Council without the <br />incorporation in this Ordinance on any such unconstitutional <br />phrase, clause, sentence, paragraph or section. <br /> <br />SECTION 3. That all ordinances or parts of ordinances <br />in conflict with this ordinance are hereby repealed. <br /> <br />SECTION 4. That the importance of this Ordinance <br />creates an emergency and an imperative public necessity so <br />that the provisions of the Charter requirihg that ordinances <br />shall be presented at three separate meetings and that no <br />ordinance shall become effective until the expiration of ten <br />(10) days following the date of its final passage be <br />suspended, and these provisions are hereby suspended, and <br />this Ordinance shall take effect and be in full force and <br />effect from and after its adoption and after its publication <br />in a newspaper of general circulation within the City as <br />provided by the City Charter of the City of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 7th day of <br /> <br />December, 1992.
