<br /> ')K <br /> on the basis of unusual changes in its cost of <br /> operations, such as revised laws, ordinances, or <br /> regulations and changes in location of delivery <br /> sites. The City may grant such adjustments, in <br /> its discretion, through amendments to this <br /> Contract. <br /> 13.03 Contractor Billings to City - The Contractor shall bill <br /> t.he City for service rendered within ten (10) days <br /> following the end of the month and the City shall pay <br /> the Contractor on or before the 25th day following the <br /> end of such month. Such billing and payment shall be <br /> based on the rates and schedules set forth in the <br /> Contract Documents. The Contractor shall be entitled <br /> to payment for services rendered irrespective of <br /> whether or not the City collects from the customer for <br /> such service. <br /> 13.04 Documentation - The Contractor shall be responsible <br /> for the cost inherent in documenting and reporting all <br /> Recyclable Material pickups by number and frequency <br /> within the recycling district and shall report such <br /> results in the approximate participation levels by <br /> percent to the City on a monthly basis. <br /> 14.00 TRANSFERABILITY OF CONTRACT <br /> ~ <br /> Other than by operation of law, no assignment of the Contract <br /> or any right accruing under this Contract shall be made in <br /> whole or in part by the Contractor without the express <br /> written consent of the City, which consent shall not be <br /> unreasonably withheld; in the event of any assignment, the <br /> assignee shall assume the liability of the Contractor. <br /> 15.00 EXCLUSIVE CONTRACT <br /> The Contractor shall have the sole and exclusive Right, to <br /> provide Recyclable Materials collection and delivery services <br /> from Residential Units within the corporate limits of the <br /> City. <br /> 16.00 OWNERSHIP <br /> Such title to Commodities that the Contractor has agreed to <br /> accept as may be passed by customers placing them for <br /> collection shall pass to the Contractor when placed in <br /> Contractor's collection vehicle, removed by Contractor from <br /> a Container, or removed by Contractor from the Residential <br /> Uni t, whichever last occurs. <br /> 17. TERMINATION <br /> Each party reserves the right to terminate this Contract <br /> based upon default in compliance with this Contract by the <br /> ~8572 - 14 - <br />
