<br /> 33 <br /> RESOLUTION 1992 - 154 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS APPROVING THE TERMS AND <br /> CONDITIONS OF A DRAINAGE EASEMENT AND <br /> MAINTENANCE AGREEMENT BETWEEN THE CITY AND SAN <br /> MARCOS FACTORY STORES, LTD.; AUTHORIZING THE <br /> CITY MANAGER TO EXECUTE THE AGREEMENT ON <br /> BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, the City Planning Commission approved the <br /> Resubdivision Plat of Factory Shops Subdivision October 13, 1992, <br /> subject to the condition that the subdivision developer, San <br /> Marcos Factory Stores, Ltd., execute and record an easement and <br /> maintenance agreement pertaining to certain drainage facilities <br /> associated with the resubdivision plat development; now, therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Drainage <br /> Easement and Maintenance Agreement attached to this Resolution <br /> between the City and San Marcos Factory Stores, Ltd. are hereby <br /> approved. ~ <br /> PART 2. That the City Manager, Larry D. Gilley is hereby <br /> authorized to execute this Agreement on behalf of the City. <br /> PART 3.
