(c) To the maximum extent practicable, pipelines constructed or relocated above <br /> ground shall be placed so as to preserve the scenic beauty and navigational use of the <br /> San Marcos River. <br /> Section 27.012. BRIDGES, CONVEYORS AND TRESTLES. To the maximum extent <br /> practicable, any bridge, conveyor, or trestle that is constructed, repaired, or relocated <br /> across the San Marcos River shall be placed so as to preserve the scenic beauty and <br /> navigational use of the San Marcos River. <br /> Section 27.013. PRIVATE PROPERTY. <br /> (a) The existing rights of the owners of private property adjacent to the San Marcos <br /> River are not affected by this chapter. <br /> (b) The unauthorized use of private property adjacent to the San Marcos River is <br /> criminal trespass under Section 30.05, Penal Code. <br /> Section 27.014. CRIMINAL PENALTY. <br /> (a) A person who violates Section 27.009 of this chapter commits an offense. <br /> (b) An offense under this section is a Class C Parks and Wildlife Code misdemeanor. <br /> Each day that a violation continues constitutes a separate offense. <br /> Section 27.015. CIVIL PENALTY. A person who violates Section 27.009 of this <br /> chapter or any rule adopted by the commission under this chapter is subject to a civil <br /> penalty of not less than $25 or more than $1,000 for each act of violation and for each day <br /> of violation. <br /> Section 27.016. ENFORCEMENT. ~ <br /> (a) At the request of the director, the attorney general shall bring suit to enjoin a <br /> violation or a threatened violation of Section 27.009 of this chapter or of a rule adopted <br /> under this chapter or to recover a civil penalty assessed under this chapter. The suit shall <br /> be brought in a district court in Travis County or in a district court in the county where a <br /> violation or threat of violation occurred. <br /> (b) If the court finds a violation or a threatened violation of this chapter or a rule <br /> adopted under this chapter, the district court may grant injunctive relief as the facts may <br /> warrant. <br /> , <br /> SECTION 2. This Act takes effect September 1 1993. <br /> SECTION 3. The importance of this legislation and the crowded condition of the <br /> calendars in both houses create an emergency and an imperative public necessity that <br /> the constitutional rule requiring bills to be read on three several days in each house be <br /> suspended, and this rule is hereby suspended. <br />
