<br />demands, or causes of action of every character occurring, <br />resulting, or arising from Consultant's negligent act or omission, <br />or other conduct or activity violative of the applicable legal <br />standard, or by any combination of the foregoing, which is a cause <br />of or contribution to the loss, cost, damage, or expense. This <br />shall include, but not be limited to, the amounts of judgements, <br />penalties, interests, court costs, legal fees, and all other <br />expenses incurred by the Owner because of such act, omission, <br />conduct, or activity. <br /> This indemnity provision shall not be limited by reason of the <br />specification of any particular insurance coverage in this <br />agreement. Consultant further agrees to obtain from its <br />contractors, subcontractors and consultants, if any, the same <br />indemnification provision in writing with respect to Owner as <br />stated hereinabove. <br />7.4 The Owner hereby agrees, to the fullest extent allowed by <br />law, to indemnify, defend and hold harmless the Consultant, its <br />affiliates, and their respective officers, employees, agents and <br />subcontractors from and against all claims and actions, losses and <br />liabilities including all expenses and attorneys fees, incidental <br />to any claim or action, based on, or arising out of, damages or <br />injuries to persons or property caused by, or arising out of, any <br />hazardous and/or toxic substances present at the site where the <br />Consultant and/or its subcontractors have performed work, except if <br />such loss, damage or injuries were caused or alleged to be caused <br />by the negligence or willful misconduct of the Consultant, its <br /> -8- <br />
