Hopkins <br /> San Marcos, Texas 78666 <br /> Dear Mr. Gilley: <br /> This letter is in regards to the contract between the City of San <br /> Marcos, Texas and E.P. Hamilton and Associates, Inc., for <br /> engineering and related professional services associated with PUC <br /> Docket 9427, LCRA application for rate increase. We were contacted <br /> and retained for the City by your attorney, Mr. Bob Kahn, of <br /> Sawtelle, Goode, Davidson and Troilo, Austin, Texas. <br /> As promised in our letter contract of August 21, 1990, we wish to <br /> keep you informed of our involvement for the aforementioned <br /> professional services. Due to the ever-changing manner in which <br /> this hearing has progressed, it has once again become necessary for <br /> us to revise our scope of services (and consequently the <br /> anticipated fee). We have been required to go through an <br /> additional 2-3 feet of RFI responses triggered by the Section 63 <br /> filings. Additionally, because the examiner ruled that the <br /> deadline is now December 1 9, 1990 as opposed to January 1991 (as <br /> Mr. Kahn had predicted), we have been forced to rotate additional <br /> staff time into this project, including overtime, as well as bring <br /> in a part-time temporary engineer to deal with the tremendous <br /> volume of data. Based on the performance in August, we are also <br /> anticipating that Mr. Kahn will want Dr. Ham i 1 ton to sit in the <br /> hearings which are expected to require an additional week or more <br /> of time due to cross examination. <br /> I have attempted to make a very conservative estimate of the <br /> additional level of effort which is anticipated, based on hearing <br /> progress to date. This estimate is $27,000 for additional effort. <br /> Of course, if the additional level of effort turns out to be less <br /> than this amount, we will simply stop work when complete and final <br /> bill the account for ç"lork actually done. <br /> Therefore, we are requesting that the cap on our contract be raised <br /> an additional $27,000, from not-to-exceed $28,000 to not-to-exceed <br /> $55,000.
