<br /> ,""'R <br /> "I " <br /> "' 11 <br />the City. <br /> 12. <br /> SEVERABILITY <br />In the event any section, subsection, paragraph, sentence, <br />phrase or word is held invalid, illegal or unconstitutional, the <br />balance of this Agreement shall stand, shall be enforceable and <br />shall be read as if the parties intended at all times to delete <br />said invalid section, subsection, paragraph, sentence, phrase or <br />word. <br /> 13. <br /> APPLICABLE LAW <br />This Agreement shall be construed under the laws of the State <br />of Texas. Venue for any action under this Agreement shall be in <br />the state District Court of Hays County, Texas. This Agreement is <br />performable in Hays County, Texas. <br /> 14. <br /> RECORDATION O~ AGREEMENT <br />A certified copy of this Agreement in recordable form shall be <br />recorded in the Deed Records of Hays County, Texas, by the City of <br />San Marcos. HEB shall be responsible for providing to the Hays <br />County Appraisal District all information necessary to give effect <br />to this Agreement. <br />This Agreement has been executed by the parties in multiple <br />originals or counterparts each having full force and effect. <br />EXECUTED this l2th day of March , 1991, by <br />
