The Tax Abatement shall not include <br />inventory, or any other personal property. <br />4. <br />RECORDS AND AUDITS <br />A. On or before April 1 of each year of this Agreement, <br />beginning in 1992, HEB shall furnish to the City certified records <br />supporting HEB's request for tax abatement for that year. These <br />records shall pertain to HEB's compliance with this Agreement for <br />the twelve months preceding the date of the report. The City shall <br />evaluate the information furnished, and shall have the right to <br />request and receive from HEB additional relevant information needed <br />to help the City determine HEB's compliance with this Agreement. <br />Upon the City's verification of compliance with this Agreement by <br />HEB, the City shall issue a tax abatement certificate to HEB <br />authorizing the Tax Abatement as described in Section 3 for the <br />current tax year. HEB shall be responsible for filing this <br />certificate with the Hays County Appraisal District for rendition <br />purposes. <br />B. At all times until the City's rights to declare default <br />against HEB have expired, the City shall have access to the <br />Property and facilities of HEB for the purpose of inspecting them <br />to ensure that the Improvements and Equipment are constructed, <br />installed, maintained and used in accordance with the conditions of <br />this Agreement. <br />
