<br /> -7- <br /> expenses incurred in connection with this contract which are not <br /> recited herein to be the obligation of Seller, shall be the <br /> obligation of Buyer. Unless otherwise paid, before Buyer shall be <br /> entitled to a refund of Earnest Money, any such costs and expenses <br /> shall be deducted therefrom and paid to the creditors entitled <br /> thereto. <br /> E. Insurance, utility charges, personal property taxes and <br /> ad valorem taxes for the current year shall be prorated at the <br /> closing effective as of the date of closing. Due to Buyer's <br /> status as a political subdivision, the Property will become exempt <br /> from ad valorem taxation as of the Closing Date. Buyer shall <br /> cause accurate readings of utility consumption to be made as of <br /> the Closing Date, and Seller shall pay its portion of utility <br /> charges after closing and at such time as statements for utility <br /> charges are received. <br /> 10. VACATION BY TENANTS. Seller represents that it has the <br /> right to terminate any and all existing leases connected with the <br /> Property and to cause all tenants to vacate the Property prior to <br /> the Closing Date. Seller agrees to give appropriate notice of <br /> termination to any and all tenants immediately upon the execution <br /> of this contract, and to thereafter, and prior to closing, cause <br /> the tenants to vacate the Property. Seller's representations and <br /> obligations hereunder shall survive the closing. <br /> 11. BROKER'S FEES: Commercial Industrial Properties Co., <br /> Listing Broker, has negotiated this sale and Seller agrees to pay <br /> Broker in Hays County, Texas, on consummation of this sale a total <br />
