<br />ARTICLE 10 <br />EXTEIft" OF AGRER!ŒNT <br /> <br />10.1 This Agreement represents the entire and integrated agreement <br />between the OWNER and the ARCHITECT and supersedes all prior <br />negotiations, representations or agreements, either written or oral. <br />This Agreement may be amended only by written instrument signed by both <br />OWNER and ARCHITECT. <br /> <br />ARTICLE 11 <br />BASIS OF COHPENSATION <br /> <br />11.1 Compensation to be paid by the OWNER for ARCHITECT's performance <br />Inder this agreement shall be a fixed fee in the amount of sixteen <br />:housand and no/lOO Dollars ($16,000.00). <br /> <br />Payment for services under this Agreement shall be made as <br />follows: <br /> <br />Phase 1 Design 30 percent $4,800.00 <br />Phase 2 Construction Drawings 40 percent $6,400.00 <br />Phase 3 Bidding 5 percent $ 800.00 <br />Phase 4 Contract Administration 25 percent $4,000.00 <br /> <br />OWNER and ARCHITECT AGREE that, if the scope of the Project or of <br />the ARCHITECT's services are changed materially, the amount of <br />compensation shall be renegotiated. <br /> <br />This Agreement shall be effective as of the day and year executed <br />by the City. <br />OWNER: CITY OF SAN MARCOS, ARCHITECT: JEFFREY H. <br />TEXAS KESTER, & ASSOCIATES <br /> <br /> <br />j I ~¡;j I A <br />By : . d ,l)jJJ By : ,.,--~ <br />Larf?!D.Ó(hlIey,\::Çity Manager. ef ey .
