<br /> -7- <br /> 10.4 If, on account of any breach or default by HS in its <br /> obligations, it shall become necessary for the CITY to use an <br /> attorney to enforce or defend any of the CITY's rights or <br /> remedies, HS agrees to pay any reasonable attorney's fees incurred <br /> by the CITY. <br /> ARTICLE 11 <br /> TERMINATION <br /> 11.1 HS may terminate this Lease by giving thirty (30) days <br /> written notice to the CITY of HS's election to so terminate. The <br /> notice shall state the date of the termination. <br /> 11.2 The CITY has the right to terminate this Lease thirty (30) <br /> days after HS ceases use of the leased premises for the provision <br /> of services as the Homespun Program. The CITY shall, after the <br /> expiration of thirty (30) days from the date HS ceased to use the <br /> leased premises for the stated purpose, give HS ten (10) days <br /> written notice that the CITY so intends to terminate this Lease <br /> because of the cessation of the use of the leased premises for the <br /> stated purposes. <br /> ARTICLE 12 <br /> MISCELLANEOUS <br /> 12.1 If any clause or provision of this Lease is illegal, invalid <br /> or unenforceable under present or future laws in effect during the <br /> term of this Lease, it is the intention of the parties. that the <br /> remainder of this Lease shall not be affected, and the parties <br /> declare that this Lease would have been entered into without the <br /> unenforceable portion. <br /> 12.2 This Lease may not be altered, changed, or amended, except by <br /> instrument in writing signed by both parties. The terms, <br /> provisions, covenants and conditions contained in this Lease shall <br /> apply to, inure to the benefit, and be binding upon the parties, <br /> and upon their respective successors in interest and legal <br /> representatives, except as otherwise expressly provided. <br /> 12.3 The captions used in this Lease are for convenience only and <br /> do not in any way limit or amplify any terms and provisions. <br /> 12.4 One or more waivers of any covenant, term or condition of <br /> this Lease by either party shall not be deemed to waive or render <br /> unnecessary consent to or approval of any subsequent similar act. <br />
