<br /> 40 <br /> RESOLUTION 1991- 51 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS EXPRESSING THE <br /> CITY'S POSITION ON PENDING STATE <br /> LEGISLATION PERTAINING TO THE EDWARDS <br /> AQUIFER7 AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the City has as its goals regarding the Edwards <br />Aquifer the following: <br />1. The preservation of spring flow at the San Marcos and <br /> Comal Springs to maintain historic riverflows, to <br /> protect endangered species habitats and to comply with <br /> state and federal endangered species laws 7 <br />2. The protection of water quality in the Edwards Aquifer, <br /> springs, rivers and downstream basins7 <br />3. The recognition of the interrelationships between the <br /> aquifer, its drainage area, recharge zone, and <br /> downstream river basins7 <br />4. The protection of the economic stability of the region <br /> by assuring adequate water supplies from the Edwards <br /> Aquifer and downstream river basins7 <br />5. The prevention of sustained overdraft of the Edwards <br /> Aquifer7 <br />6. The prevention of waste of water resources in municipal, <br /> agricultural, and industrial useS7 <br />7. The development of incentives for and implementation of <br /> new technologies for water conservation, reuse and <br /> alternate water supplies7 and <br />8. The implementation of regional management goals by local <br /> jurisdictions where effective and practical7 and <br />WHEREAS, the City's objectives to achieve these goals are as <br />follows: <br />1. The establishment of an aquifer management program <br /> through a regional district to include all counties <br /> overlying the Edwards Aquifer, with representation from <br /> downstream users as appropriate 7 <br />2. The adoption of a region-wide drought management plan to <br /> mitigate low aquifer levels in periods of drought or <br /> overpumpage7 <br />3. The adoption of regional programs for the protection of <br /> water quality, including studies of the bad water line, <br /> protection of recharge structures and the recharge zone, <br /> and prevention of point-source pollution and non-point <br /> source pollution7 <br />4. The adoption of, and the development of incentives for, <br /> local implementation of effective conservation measures <br /> appropriate for municipal, industrial and agricultural <br /> uses, including regulations for water conserving <br /> plumbing and irrigation devices, dry year option, and <br /> conservation water rate structures7 <br />5. The adoption of, and the development of incentives for, <br /> effective water reuse programs7 <br />6. Region-wide long-range planning, to include the Edwards <br /> Aquifer region and downstream river basins, for future <br /> alternate water supplies and their financing7 <br />
