<br /> 42 <br /> RESOLUTION 1991- 53 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, APPROVING THE RELEASE OF <br /> AN ELECTRIC UTILITY EASEMENT TO BALCONES BANC <br /> SAVINGS ASSOCIATION IN EXCHANGE FOR THE <br /> DEDICATION OF A RELOCATED EASEMENT TO THE <br /> CITY~ AUTHORIZING THE CITY MANAGER TO EXECUTE <br /> THE RELEASE 7 AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, by instrument dated April 17, 1984 and filed in <br /> Volume 435, page 214 of the Real Property Record s of Hays <br /> County, Texas, the Lm.¡er Colorado River Authority (LCRA) <br /> acquired an electric utility easement across Lot 4, Block 26 <br /> of the Original Town of San Marcos, Hays County, Texas7 and, <br /> \'ffiE REAS, LCRA transferred ownership of this easement to <br /> the City by instrument dated November 4, 1986 and recorded <br /> in Volume 634, page 818 of the Deed Records of Hays County, <br /> Texas7 and, <br /> WHEREAS, by inadvertent error this easement is <br /> incorrectly located relative to existing utility lines and <br /> buildings on such lot7 and, <br /> \'ffiEREAS, the owner of such lot, Balcones Banc Savings <br /> Association, has requested the City to release the existing <br /> easement in exchange for the dedication by Balcones Banc to <br /> the City of an electric utility easement across such lots in <br /> the proper location7 now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That approval is hereby given to the City's <br /> release of the existing electric utility easement described <br /> above to Balcones Banc Savings Association in exchange for <br /> the dedication of a relocated electric utility easement to <br /> the City by Balcones Banc. <br /> PART 2. That the City Manager, Larry D. Gilley, is <br /> hereby authorized to execute the Release of Easement attached <br /> to this resolution as Exhibit "A" in exchange for the receipt <br /> of an executed Easement from Balcones Banc Savings <br /> Association in the form attached as Exhibit "B". <br /> PART 3.
