<br /> 47 <br /> PROFESSIONAL SERVICES AGREEMENT <br /> This AGREEMENT is made between the CITY OF SAN MARCOS, TEXAS, <br /> hereinafter referred to as "OWNER", 630 East Hopkins, San Marcos, <br /> Texas 78666, and BYRN AND ASSOCIATES, INC., 202-3 South C. M. <br /> Allen parkway, San Marcos, Texas 78666, hereinafter referred to <br /> as "ENGINEER", for engineering services in connection with the <br /> PHASE II, NORTHEAST IH 35 WATER LINE EXTENSION PROJECT, including <br /> 100 LF Boring, l2l6LF l6" C-905 Water Line, 720 LF 16" C-l5l Water <br /> Line and Appurtenances, in accordance with the design parameters <br /> utilized in the preparation of the Phase I, Northeast IH 35 Water <br /> Line Extension Project. <br /> WITNESSETH: Owner and Engineer do hereby agree as follows: <br /> AR~ICLE 1 <br /> EHGlREER'S SERVICES AND RESPONSIBILITIES <br /> Engineer shall be responsible for the proper, accurate and <br /> adequate design of the PHASE II, NORTHEAST IH 35 WATER LINE <br /> EXTENSION PROJECT (the "Project") as well as the preparation of <br /> accurate and adequate plans, specifications, reports and other <br /> construction contract documents for the Project, and any <br /> provisions in this Agreement pertaining to Owner's review, <br /> approval and/or acceptance of reports, plans, specifications, <br /> construction contract documents, or other written materials <br /> prepared by Engineer or its consultants, contractors, and <br /> subcontractors in connection with this Project shall not be deemed <br /> to diminish Engineer's responsibility therefor.
