<br /> 72 <br /> FOREIGN TRADE ZONE LANDOWNERS AGREEMENT <br />This Foreign Trade Zone Landowners Agreement (the <br />"Agreement") is entered into as of the 6th day of November, 1990, <br />by and among Foreign Trade Zone of Central Texas, Inc., a Texas <br />non-profit corporation ("Grantee"), and each of the parties <br />designated as "Owners" on the signature pages of this Agreement <br />("Owners"). <br /> RECITALS <br />WHEREAS, Grantee intends to apply for a grant of authority <br />from the Foreign Trade Zones Board to establish a general purpose <br />foreign trade zone at the Austin Port of Entry (the "Zone") <br />consisting of the properties listed on Exhibit A (each property <br />being singularly referred to as a "Zone site" and collectively <br />referred to as the "Zone Sites"); and <br />WHEREAS, the Owners collectively own all of the Zone sites <br />and each of the Owners desires that its Zone Site(s) be included <br />in the Zone and governed by and subj ect to this Agreement wi th <br />respect to its inclusion in the Zone; <br />NOW, THEREFORE, in consideration of the mutual covenants and <br />agreements set forth below, the parties agree as follows: <br /> - 1 - <br />02:16590208.90 <br />
