(13) MOTION: Upon a motion made by Council Member Scott and a second by Council Member Porterfield, the City Council voted six (6) for, none (0) opposed, one (1) absent, Council Member Thomaides to approve Resolution 2013 -84R, as previously captioned. The motion carried unanimously. Public Hearing 16.7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2013 -27, revising the Building Permit Fee Schedule previously adopted by Ordinance 2013 -04 by setting a maximum fee of $3,000 per proiect for deck, patio, and roof projects; making this change retroactive to January 1, 2013; authorizing the City Manager to refund building permit fees paid on after January 1, 2013 in excess of the $3,000 per Project limit set by this Ordinance; providing a savings clause; providing for the repeal of any conflicting provisions; and providing an effective date; and consider approval of Ordinance 2013 -27, on the first of two readings. Kristy Stark, Assistant Director of Development Services, provided a brief presentation. Non Consent Agenda 17.Consider approval of Resolution 2013 -79R, approving a partial assignment of a Development Agreement originally approved by Resolution No. 2009 -166R from Craddock Avenue Partners, L.L.C. to Capstone Collegiate Communities, L.L.C. as to 35.429 acres of land out of a 148.774 acre tract subject to the Development Agreement located along Craddock Avenue at Wonder World Drive also known as the Buie Tract; authorizing the City Manager to execute a consent to the partial assignment on behalf of the City; and declaring an effective date. MOTION: Upon a motion made by Council Member Prather and a second by Council Member Scott, MOTION TO POSTPONE: Upon a motion made by Council Member Thomaides and a second by Council Member Becak, the City Council voted (7) for and none (0) opposed, to postpone until a workshop could be scheduled. The motion carried unanimously. 18.Consider recommendation of the Council Subcommittee and an offer of incentives regarding the public improvement district request for the Gas Lamp Proiect, and provide direction to Staff.
