Mr. Brown moved to ap- <br />prove the minutes and Mr. Farr seconded the motion. On roll call <br />the following vote was recorded: <br /> <br />AYE: Brown, Farr, Guerra, Craddock, Moore. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Kissler, Kreczmer. <br /> <br />Mayor Craddock opened a public hearing to consider approval of a Zon- <br />ing Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY ZONING 5.750 ACRES OUT OF THE <br />J. M. VERAMENDI LEAGUE NO.2 IN HAYS COUNTY, TEXAS <br />(LOCATED IN THE BLANCO GARDENS SUBDIVISION), FROM <br />"R-l" (SINGLE-FAMILY DWELLING DISTRICT) TO "MH" (MO- <br />BILE HOME DISTRICT). <br /> <br />Mayor Craddock asked if anyone wished to speak in favor of the rezoning <br />request and no one did. Mayor Craddock asked if anyone wished to speak <br />in opposition to the request. Rudy Villalpando stated the Zoning Commis- <br />sion had unanimously opposed the zoning change. No one else wished to <br />speak in favor or in opposition to the zoning change, so Mayor Craddock <br />closed the public hearing. Mr. Guerra moved for denial of the zoning <br />change and Mr. Farr seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock opened a public hearing to consider approval of an <br />Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING APPENDIX C OF THE CODE OF <br />ORDINANCES OF SAID CITY TO DELEGATE CERTAIN DUTIES <br />AND RESPONSIBILITIES FORMERLY HELD BY THE PLANNING <br />AND ZONING COMMISSION AND THE ENVIRONMENTAL ADVISORY <br />COMMITTEE OF SAID CITY TO THE PLANNING COMMISSION, <br />TO PROVIDE FOR THE SETTING OF FEES AND TO CHANGE PRO- <br />CEDURES FOR APPEALS; AMENDING CHAPTER 14 1/2 OF SAID <br />CODE OF ORDINANCES TO DELEGATE CERTAIN DUTIES AND RE- <br />SPONSIBILITIES FORMERLY HELD BY THE PLANNING AND ZON- <br />ING COMMISSION OF SAID CITY TO THE ZONING COMMISSION; <br />AMENDING APPENDIX A OF THE CODE OF ORDINANCES OF SAID <br />CITY TO DELEGATE CERTAIN DUTIES AND RESPONSIBILITIES <br />FORMERLY HELD BY THE PLANNING AND ZONING COMMISSION <br />OF SAID CITY TO THE ZONING COMMISSION, TO CHANGE DE- <br />FINITIONS, TO CHANGE REQUIREMENTS PERTAINING TO FENCES <br />AND SHRUBBERY IN R-l, R-2 AND TH ZONING DISTRICTS, TO <br />CHANGE REQUIREMENTS FOR PARKING SPACES; PROVIDLNG FOR <br />SEVERABILITY; PROVIDING A PENALTY AND DECLARING AN EF- <br />FECTIVE DATE. <br /> <br />Joe Garza, City Planner, stated the amendments were mostly houseclean- <br />ing. The Zoning Commission had reviewed the contents of this Ordinanc~ <br />and were recommending its a~proval to the Council. There was a discus- <br />sion regarding holding publlc hearings or not holding public hearings <br />when permits are given to owners of bars. Jane Wilson stated she thought <br />the Staff should not handle this function and public hearings were needed <br />for public awareness. Jack Lindstrom stated he thought the Council <br />should table the matter and let it be presented to the Planning and <br />Zoning Commissions. Mr. Farr raised some questions regarding PUD de- <br />velopment. No one else wished to speak in favor or in opposition to <br />
