<br /> -2- <br /> (7) Public areas and common areas of <br /> places of employment; and <br /> (8) Theaters. <br /> (B) All enclosed indoor areas of the <br /> following which have not been designated <br /> as smoking areas under Sec. 16-72: <br /> (1) Private offices in buildings under <br /> the control of the city, a county, <br /> or other governmental agency; <br /> (2) Private offices in primary and <br /> secondary school buildings; <br /> (3) Office, warehouse and storage areas <br /> in grocery stores and other retail <br /> stores; <br /> (4) Areas of places of emploYment that <br /> are not open to the public; <br /> (5) Bowling centers; <br /> (6) Private recreational facilities, <br /> such as pool halls and amusement <br /> machine room rooms; <br /> (7) Restaurants; <br /> (8) Bars, the major business of which is <br /> not on-premises sales and <br /> consumption of alcoholic beverages; <br /> and, <br /> (9) Guest rooms in hotels and motels. <br />(2) "Common area" means an area such as a hallway, <br /> employee lounge or lunchroom, or restroom to <br /> which more than one employee has common <br /> access; it includes work or office areas <br /> shared by two or more employees. <br />(3) "Employee" means any person who is employed by <br /> an employer in consideration for monetary <br /> compensation or profit. <br />(4) "Employer" means any person, partnership, <br /> corporation, association or other entity, that <br /> employs one or more persons. <br />(5) "Place of emploYment" means any enclosed <br /> indoor area under the control of an employer <br /> to which one or more employees have access <br /> during the course of emploYment. <br />(6) "Public area" means areas such as lobbies, <br /> reception areas, retail merchandise display <br /> areas, restrooms and meeting rooms where <br /> members of the public are commonly present. <br />(7) "Service Line" means any indoor line at which <br /> one or more persons are waiting for or <br /> receiving service of any kind, whether or not <br /> such service involves the exchange of money. <br />(8) "Smoke", "Smokes" or "Smoking" includes the <br /> carrying or holding of a lighted pipe, cigar <br /> or cigarette of any kind, or any other lighted <br />
