<br /> -4- <br /> areas; and <br /> (6) not include service line or cashier <br /> areas. <br /> (c) In the event the person in control of a <br />building or facility can demonstrate that the users <br />normally requesting a smoking area constitute such a <br />large portion of the users of the building or facility <br />that it is impracticable for the person in control to <br />meet the requirements of sections 16-72(b) without <br />structural or other physical changes or significant <br />expenditures, the person in control may designate an <br />entire area as a smoking area, notwithstanding the <br />requirements of Sec. 16-72 (b) (1). <br /> (d) Notwithstanding the definition of clean air <br />areas in Section 16-70(1), the entire area of the <br />following facilities may be designated a smoking area, <br />but such facilities are encouraged, whenever possible, to <br />establish specific smoking areas in accordance with <br />subsections (a) and (b) above: <br /> (1) A bar, the major business of which is on- <br /> premises sales and consumption of <br /> alcoholic beverages; <br /> (2) A separated bar area of a restaurant; <br /> (3) A tobacco specialty retail shop; and, <br /> (4) An establishment consisting of an <br /> enclosed area of 800 square feet or less. <br />Sec. 16-73. Postinq of signs: means of extinquishment. <br /> <br /> (a) Except as provided by the preceding section, the <br />person in control of a clean air area shall place a sign <br />visible at each entrance to the premises, notifying <br />persons entering the premises that smoking is prohibited, <br />or that smoking is prohibited except in designated <br />smoking areas. <br /> (b) The person in control of a facility designated <br />in its entirety as a smoking area shall place a sign at <br />each entrance to the premises which is clearly visible <br />and states that smoking is permitted throughout the <br />entire area. <br /> (c) The person in control of a clean air area where <br />signs are required to be posted under subsection (a) <br />above shall provide ashtrays, containers or other means <br />o~ extinguishing smoking materials in proximity to the <br />s1gns. <br /> (d) Required signs may consist of wording and/or <br />universal sYmbols. <br />Sec. 16-74. Places of emÐloyment. <br /> <br /> Each employer who operates a place of emploYment in <br />the city shall adopt, implement and maintain a written <br />clean air policy which shall contain, at a minimum, the <br />following provisions and requirements: <br /> (l) Any nonsmoking employee may object to his or <br /> her employer about the designation of a <br /> smoking area in any portion of his or her <br />
