SAN 1v1ARCOS, TEXAS, INCREASING WATER AND WASTEWATER RAlliS ESTABLISHED UNDER SECTIONS 86.231 AND 86~262 OF THE CITY CODE; lNCREASING SURCHARGE RATES FOR ll\lDUSTRIAL WASTEWATER DISCHARGES UNDER SECTION 86.132 OF TIIE CITY CODE;. INCLUDWG PROCEDURAL PROVISIONS; AND PROVIDWG FOR PENALTIES . BE 11~ ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN 1V1ARCOS, TEXAS: SECTION 1.. The water rates established under Section 86.231 of the San Marcos City Code are amended to read as shown on the attached Exhibit A, which is made a part of this ordinance for all purposes.. SECTION 2. The wastewater (sewer) rates established under Section 86.262 of the City Code are amended. to read as shown on the attached Exhibit B, which is made a part of this ordinance for all purposes. SECTION 36 The wastewater (sewer) surcharge rates established under Section 86..132 of the City Code are amended to read as 'shown on the attacbed Exhibit C, which is made a part of this ordinance for all purposes~ SECTION 4. The Wholesale. Water Treatment Rate for treatment of raw water at the City:lg Surface Water Treatment Plant is increased from $1.33 to $1~46 per thousand gallons.. SECTION 5~ If any word, phrase, clause, sentence~ or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jUrisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portioa SECTION 5.. All ordinances and resolution or parts of ordinances or resolutions in conflict with. this ordinance are repealed. SECTION 6. Any person violating any prOVISIon of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 7. This Ordinance will take effect ten days after the date of its final passage, and it will apply to all billings issued on and after October 1, 2005a The City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
