ORDINANCE NO. 2007- 40 R AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADOPTING A REVISED SAN MARCOS HORIZONS CITY MASTER PLAN SECTOR FOUR PLAN; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. Section 3.1.1.1 of the San Marcos Land Development Code adopts the San Marcos Horizons City Master Plan as the master plan for the physical development of the City, and Section 3.1.1.3 of the City Land Development Code provides for the adoption of sector plans as appendices to the San Marcos Horizons City Master Plan. 2. Section 7.02 of the City Charter requires the City Planning and Zoning Commission to "perform an ongoing review of the city's master plan to include... holding public hearings and making recommendations to the city council regarding updates to the land use ... [ element] at least once every three years". 3. The City Council adopted the Sector Four Plan on June 28, 1999. The Sector Four Plan has not been amended. 6. The Planning and Zoning Commission held a public hearing on a revised Sector Four Plan on February 13,2007, and voted on February 27,2007, to recommend the adoption ofarevised Sector One, a revised Sector Two and a Revised Sector Three Plan by the City Council. 7. The City Council conducted a public hearing on the adoption of the revised Sector Four Plan on June 19,2007. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Sector Four Plan adopted by the City Council on June 28, 1999 is repealed, and the revised Sector Four Plan attached to this ordinance is adopted. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed.
