<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br /> ZONING MAP OF THE CITY BY ZONING LOTS 1-3,
<br /> BLOCK 7, OF THE LINDSEY AND HARVEY ADDITION TO
<br /> THE CITY OF SAN MARCOS, TEXAS, AS RECORDED IN
<br /> VOLUME E, PAGE 416 OF THE HAYS COUNTY DEED
<br /> RECORDS, LOCATED AT 502 MOORE STREET AND 456
<br /> LINDSEY STREET FROM "R-1" SINGLE-FAMILY
<br /> DWELLING DISTRICT (LOW DENSITY) TO "MF-3"
<br /> MULTI-FAMILY DWELLING DISTRICT (HIGH DENSITY)
<br /> AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on April 2, 1991, the Zoning commission of the city
<br /> of San Marcos held a public hearing regarding a request to change
<br /> the zoning from "R-1" Single-family Dwelling District (low-density)
<br /> to "MF-3" Multi-family Dwelling District (high density) for Lots 1-
<br /> 3, Block 7 of the Lindsey and Harvey Addition to San Marcos, Texas
<br /> as recorded in Volume E, Page 416 of the Hays County Deed Records,
<br /> and,
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br /> Zoning commission did, on April 2, 1991, consider the request and
<br /> voted to approve it and has recommended that the request be
<br /> approved by the city Council of the City; and,
<br /> WHEREAS, the City Council held a public hearing on the 8th
<br /> day of July , 1991, regarding the request; and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code of Ordinances of the City of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, the City Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the
<br /> public health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the Official Zoning Map of the City, as
<br /> described in section 3 of the General Zoning Ordinance is hereby
<br /> amended to rezone the following described real property located in
<br /> San Marcos, Hays County, Texas, which is presently zoned "R-1"
<br /> Single-family Dwelling District (low-density) to "MF-3" Multi-
<br /> family Dwelling District (high density):
<br /> LOTS 1-3, BLOCK 7, OF THE LINDSEY AND HARVEY ADDITION TO
<br /> THE CITY OF SAN MARCOS, TEXAS, AS RECORDED IN VOLUME 3,
<br /> PAGE 416 OF THE HAYS COUNTY DEED RECORDS.
<br /> SECTION 2. That this Ordinance shall be in effect ten (10)
<br /> days from and after its passage and after it has been subject to
<br /> reconsideration by the Council at its next regular meeting
<br /> following its passage, and providing that the Council did not vote
<br /> to reconsider it. If reconsidered on July 22, 1991 it shall be
<br /> in effect ten days from and after its passage on that date if
<br /> approved. It shall not go into effect if denied. If not
<br /> reconsidered and approved it shall be published in a newspaper of
<br /> general circulation in the area as required by the Charter of the
<br /> City of San Marcos, Texas.
<br /> PASSED, APPROVED AND ADOPTED this 8th day of July , 1991,
<br /> subject to reconsideration at the next regular city Council meeting
<br /> scheduled for July 22, 1991 .
