That section 35(H) (3) (b) 4. of Appendix A, General <br />Zoning Ordinance of the San Marcos Code of Ordinances is amended <br />wi th regard to establishments dispensing liquor for on-premise <br />consumption, and their compliance with local safety codes, to read <br />as follows: <br /> 4. The place of business shall be designed, constructed and <br /> maintained at all times in compliance with all fire, <br /> health, electrical, plumbing, and building code standards <br /> and regulations in effect within the City of San Marcos. <br /> Particular attention shall be given to the location of <br /> exits and seating arrangements in accordance with the <br /> adopted Fire Prevention Code. The maximum occupancy <br /> limit for each structure shall be established as provided <br /> in the Standard Building Code. <br /> SECTION 10. That section 35(H) (3)(b) 14. is hereby added to <br />Appendix A, General Zoning Ordinance of the San Marcos Code of <br />Ordinances to read as follows: <br /> 14. Permitted establishments which also have a TABC <br /> license for sales of alcoholic beverages for off- <br /> premise consumption, where drive-up or drive-through <br /> facilities are the only means provided to serve <br /> customers, shall comply with the following additional <br /> requirements: <br /> a. The opening or consumption of alcoholic beverages <br /> by customers is prohibited on the premises except <br /> in the designated customer seating area. There <br /> shall be a designated customer seating area for <br /> no more than one person. <br /> b. A sign prohibiting the opening or consumption of <br /> alcoholic beverages by customers on the premises, <br /> except in the designated customer seating area, <br /> shall be prominently displayed at the point of <br /> sale. <br /> c. There shall be no additional facilities, other <br /> than rest-rooms and running water, provided <br /> through building or site alterations beyond what <br /> is necessary for the intended sale of beverages <br /> for off-premise consumption. <br /> SECTION 11. That section 35(H) (3) (d) of Appendix A, General <br />Zoning Ordinance of the San Marcos Code of Ordinances be amended <br />with regard to the renewal of specific use permits to <br />establishments dispensing alcohol for on-premise consumption to <br />read as follows: <br /> (d) Renewal: <br /> 1. Period of specific use and renewal: Specific Use <br /> Permits for establishments dispensing alcoholic <br /> beverages for on-premise consumption shall <br /> coincide in duration with TABC licenses unless <br /> otherwise revoked in accordance with the <br /> provisions of Section 35 (H) (3) (f). <br /> 2. TABC Specific Use Permits issued by the City <br /> shall require renewal or reapplication if there <br /> is any change in the status of the state license <br /> or permit such as cancellation, expiration or <br /> renewal. <br />
